The buyer

The purchaser is advised that accepting the offer entails a commitment to pay for the goods. Once the purchaser has selected the product they intend to buy, they acknowledge and agree to these terms and conditions by clicking the acceptance button.

The seller

The seller is responsible for bearing the risks associated with any potential damage to the product during transportation until it is safely delivered to the consumer.

Payment information and prices

At the time of payment, the buyer has the option to select from various payment methods provided through the payment gateway, including credit or debit cards such as Visa, Mastercard, or American Express. The characteristics and prices of the products are as displayed on the screen. The availability of products or services is subject to stock availability. The prices presented on the screen are in euros inclusive of VAT and represent the current pricing. In all instances, the sales contract between the buyer and the seller is contingent upon the condition that the product is available and that full payment is made. The seller commits to confirming or declining the availability of the product requested by the buyer within a maximum of 5 days. In the event that the same product is simultaneously purchased by multiple buyers, it will be allocated to the first buyer who successfully completes their order. If after a period of 5 days from the date of order validation, the seller has not provided notice regarding the product’s availability or if the buyer has not finalized the payment within the same timeframe, the contract between the buyer and the seller will be dissolved and both parties will be released from their respective obligations.

Shipments

The shipping costs will vary based on the destination, size, and weight of the purchased product. The Gallery offers shipping to nearly all parts of the world, and the website will automatically calculate shipping costs during the checkout process. If the desired destination is not listed, customers can inquire about the details by contacting info@aurealvergaragallery.com. Please be aware that for certain destinations shipping may necessitate special documentation and procedures. Shipments are dispatched from Tuesdays to Fridays. Orders placed on Saturdays, Sundays, and Mondays will be shipped starting from the following Tuesday immediately after the purchase. The estimated shipping duration is approximately 10 working days. Please note that the delivery time may vary depending on the type of artwork and the destination of the shipment. The date and shipping information will be communicated via email. The customer agrees to track and receive the package. If the order is returned to the Gallery due to the recipient’s absence at the delivery address or failure to pick it up from the courier office within the specified timeframe, the customer will be responsible for covering the costs associated with a new shipment. Taxes at the destination, such as customs duties and any other applicable fees, are the responsibility of the recipient and must be paid upon arrival at the destination. Galeria Aureal Vergara Shop SL is not liable for any potential additional costs of this nature. Galeria Aureal Vergara Shop SL bears no responsibility for errors or damages arising from delivery when the address provided by the customer does not match the intended delivery location specified by the customer. The delivery is considered completed from the moment in which the work has been made available to the customer at the place of delivery indicated by the customer. In the event that the buyer is not present at the specified address during the delivery of the artwork, the carrier will leave a notice detailing the steps for rescheduling the delivery. If the customer fails to contact the carrier to arrange a new delivery date, the artworks will be returned to Aureal Vergara Gallery Shop SL and the customer will be responsible for both the shipping and return costs. Regarding items to be exchanged or returned by mail, the shipping costs will be the responsibility of the customer and under no circumstances will Aureal Vergara Gallery Shop SL accept returns sent with freight collect charges. Personal data received during the purchase process may only be used for this purpose. The buyer’s email address may be included in the Gallery’s database.

Returns or exchanges

We do not accept exchanges or returns of graphic artworks and original artworks. Refunds will only be processed in the event that graphic artworks and original artworks arrive in a damaged condition and the claim is submitted within 24 hours of receiving the shipment. Claims made after the 24-hour window will not be accepted. To initiate an exchange for book and catalog products, the buyer must request the return within 14 calendar days. The price of the item will be refunded within 14 days of receiving the return. The buyer will have the choice to either receive a store purchase coupon for the value of the returned product or exchange it for an item of equivalent value. If the amount already paid does not cover the full value, the gallery will issue a voucher with no expiration date for the remaining amount. Any return of purchased items by the buyer must be carefully packaged. The buyer is required to provide the purchase receipt and return the product in pristine condition, complete with tags and its original packaging. Please note that returns will not be accepted if the items show signs of staining or damage. The customer will be responsible for covering the shipping costs for items they wish to exchange or return by mail, and under no circumstances will Galeria Aa Shop SL accept returns sent with freight collect charges. The gallery will provide a voucher for the same purchase amount which will have no expiration date. The customer is responsible for sending the books and catalog products to the gallery in impeccable condition, including all labels, securely packaged and protected. Shipping costs for the return will be at the customer’s expense.

Right of Withdrawal

Withdrawal Period

The withdrawal period will expire after 14 calendar days from the day on which the buyer, or a third party other than the carrier and indicated by the buyer, acquires physical possession of the goods.

How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the buyer must notify Aureal Vergara Gallery of their decision to withdraw from the contract through a clear statement. This can be done via email at info@aurealvergaragallery.com or by post to the following address:

Effects of Withdrawal

If the buyer withdraws from this contract, all payments made, including the costs of delivery (except for any additional costs resulting from the buyer’s choice of a delivery method other than the least expensive standard delivery offered), will be reimbursed without undue delay and in any event no later than 14 calendar days from the day on which Aureal Vergara Gallery is informed of the decision to withdraw.

The refund will be processed using the same payment method used for the initial transaction, unless otherwise agreed. The buyer will not incur any fees as a result of the reimbursement.

Return of Goods

The buyer must return the goods to Aureal Vergara Gallery at the address indicated above without undue delay and in any event no later than 14 calendar days from the day on which the withdrawal notification is sent. The buyer will bear the direct cost of returning the goods.

The buyer is only liable for any diminished value of the goods resulting from handling them in a manner other than what is necessary to establish the nature, characteristics, and functioning of the goods.
